These are the PulsoMax Terms of Use. We recommend that you carefully read all the information before placing any order on our platform.
Pulsomax Terms and Conditions of Use
These Terms and Conditions of Use govern access to and use of the Pulsomax platform, available through its website, dashboard, pages, tools, digital resources, customer service channels, registration areas, and other related functionalities.
Pulsomax operates as a digital platform, service marketplace, and digital content and solutions agency. Through the platform, clients can contract services offered directly by Pulsomax or by registered independent vendors.
In addition to operating as a marketplace, Pulsomax can also act directly as a content agency for social media, SEO, digital marketing, content creation, production of visual materials, consulting, online presence strategies, services focused on WordPress, WooCommerce, installation and configuration of themes and plugins, page development, digital optimizations, and other services compatible with its business proposal.
Therefore, the services available on Pulsomax may be offered directly by Pulsomax itself or by independent sellers registered on the platform, as indicated in each offer, advertisement, service page, or order.
By accessing, registering, buying, selling, advertising, contracting services, or using any feature of Pulsomax, the user declares that they have read, understood, and accepted these Terms and Conditions of Use, as well as the Privacy Policy, the Seller Policy, the Refund Policy, and other applicable rules of the platform.
If the user does not agree with these Terms, they must immediately discontinue use of the platform.
1. Definitions
For a better understanding of these Terms, the following definitions apply:
Pulsomax: a digital platform, service marketplace, and digital content and solutions agency responsible for providing a technological environment for contracting, selling, promoting, and brokering services.
User: any person who accesses or uses the platform, including visitors, customers, and sellers.
Client: a user who contracts or purchases services, digital products, creative, technological, professional, or digital solutions offered on the platform.
Seller: an independent user who registers, advertises, offers, sells, and delivers services, digital products, or solutions through Pulsomax.
Service: any activity, delivery, solution, digital product, consulting, configuration, installation, creation, analysis, production, optimization, development, or work offered through the platform.
Order: contract placed by the customer within Pulsomax.
Dispute: a request submitted by the customer for analysis of a possible failure, delay, non-delivery, incomplete delivery, or discrepancy between the advertised service and the service received.
Content: texts, images, videos, files, codes, trademarks, descriptions, advertisements, comments, reviews, documents, and other materials inserted or made available on the platform.
2. Nature of the platform and operation of Pulsomax
Pulsomax operates as a digital platform, service marketplace, and agency for digital content and solutions.
As a marketplace, Pulsomax provides a technological infrastructure to connect customers with independent sellers, enabling the registration of services, display of offers, order processing, payment organization, communication between parties, delivery tracking, dispute analysis, and user experience management.
As a content and digital solutions agency, Pulsomax can also directly offer its own services related to social media, content creation, design, digital marketing, SEO, WordPress, WooCommerce, plugins, themes, pages, automations, consulting, digital optimizations, and other professional services compatible with its area of expertise.
When the service is offered by an independent seller, the seller will be directly responsible for the execution, delivery, quality, support, and compliance with the advertised conditions.
When the service is offered directly by Pulsomax, Pulsomax itself will be responsible for executing the service, according to the conditions described in the respective offer, service page, commercial proposal, or order.
Pulsomax is not an employer, partner, representative, commercial agent, or universal guarantor of the services offered by independent sellers. Each seller operates autonomously and is responsible for the legality, description, execution, delivery, quality, support, and compliance with the conditions advertised in their own services.
The presence of a service on the platform does not imply unrestricted approval, absolute guarantee of results, or direct responsibility of Pulsomax regarding the method, origin, execution, or delivery performed by independent sellers.
Pulsomax may, at its discretion, create, modify, limit, remove, reorganize, or highlight categories, services, advertisements, and offers, seeking to maintain the quality, security, transparency, and organization of the platform.
3. Acceptance of terms
By using Pulsomax, the user declares that:

has the legal capacity to accept these Terms;

will use the platform in a lawful, ethical and responsible manner;

will provide true, complete and up-to-date information;

You will respect these Terms, the Privacy Policy, the Seller Policy, and other platform rules;

You will not use Pulsomax for illegal, abusive, fraudulent practices or practices that are harmful to third parties.
Continued use of the platform after updates to these Terms will be considered acceptance of the new conditions.
4. User registration
To buy, sell, or use certain features of Pulsomax, the user may need to create an account.
The user is responsible for keeping their data up to date, protecting their login credentials, and ensuring the security of their account.
Pulsomax may request additional information, documents, validations, or confirmations for security purposes, fraud prevention, legal compliance, feature activation, payments, transfers, or risk analysis.
It is forbidden:

Create an account with fake information;

Using someone else's identity without authorization;

Creating duplicate accounts to circumvent the rules;

sell, transfer or assign an account to third parties;

Accessing another user's account without authorization;

Using the platform for fraud, scams, or illegal activities.
Pulsomax may suspend, limit, or terminate accounts when it identifies inconsistencies, risks, rule violations, or suspected misuse.
5. Types of users
Pulsomax may offer different account types, including customer accounts and seller accounts.
The customer will be able to search, hire, pay for, track orders, communicate with sellers, rate services, and file disputes when applicable.
The seller will be able to register services, manage ads, receive orders, communicate with customers, deliver services, track balance, request payments, and manage their reputation on the platform.
Pulsomax may create, modify, limit, or remove functionalities from each account type according to technical, commercial, operational, or security criteria.
6. Permitted services
Pulsomax allows the offering of digital, creative, professional, technological, and online-related services, provided they are legal, transparently described, and respect the rights of third parties.
The services may be offered directly by Pulsomax or by independent vendors registered on the platform.
The following may be accepted, among others:

content agency services for social media;

Creating content for Instagram, TikTok, YouTube, Facebook, LinkedIn, and other digital platforms;
-
Social media consulting;
-
Management, analysis and optimization of digital profiles;
-
Creation of banners, artwork, carousels, covers, posts and visual materials;
-
Video editing and content production;
-
digital marketing services;
-
SEO and search engine optimization services;
-
Production of texts, descriptions, articles, business pages, and institutional content;
-
creation, installation, configuration or customization of websites;
-
Installation, configuration, or customization of plugins;
-
Themes, templates, and resources for WordPress;
-
Services related to WooCommerce;
-
creation and optimization of sales pages;
-
audits, analyses and reports;
-
Automation, tools and digital solutions;
-
Mentoring, training, and personalized services;
-
other services compatible with the platform's proposal.
Pulsomax may create its own categories, subcategories, editorial criteria, and standards for organizing its services.
7. Prohibited services
It is prohibited to register, advertise, buy, sell, or broker services that:

violate laws, regulations, or decisions of competent authorities;
-
infringe copyrights, trademarks, patents, licenses, image rights, privacy rights, or other rights of third parties;
-
involve piracy, unauthorized copies, leaked products, cloned products, or irregular licenses;
-
Use materials, code, images, videos, text, plugins, themes, or files without authorization;
-
promise false, impossible, misleading, or unverifiable results;
-
mislead the customer regarding deadlines, quality, method, origin, limitations, or results;
-
involve unauthorized access to accounts, systems, databases, platforms, or private information;
-
involve hacking, fraud, social engineering, spam, misuse, or abusive automation;
-
Use personal data without authorization;
-
compromise the security of customers, users, systems, external platforms, or third parties;
-
contain offensive, discriminatory, illegal, misleading or harmful material;
-
may generate legal, financial, operational or reputational risk to Pulsomax.
Pulsomax may remove, suspend, refuse, or limit any advertisement, service, account, or content that it deems incompatible with these Terms, even if not expressly listed above.
8. Responsibility of sellers
The seller is solely responsible for the services they advertise, sell, and deliver.
It is the seller's responsibility to:

Register true, clear, and complete information;

meet the deadline stated in the advertisement;
-
deliver the service as described;
-
provide adequate customer support;
-
to answer questions, requests and disputes;
-
Respect copyrights, trademarks, licenses, and the rights of third parties;
-
to protect data, files, access, and received information;
-
comply with applicable legislation;
-
Please observe Pulsomax's Seller Policy.
The seller declares that they possess the technical, legal, and operational capacity to perform the advertised services.
Failure to comply with the seller's obligations may result in warnings, removal of listings, balance freezes, order cancellations, customer refunds, account suspension, or termination.
9. Customer Responsibility
The client is responsible for providing accurate, complete, and necessary information for the execution of the contracted service.
It is the customer's responsibility:

Read the service description carefully before purchasing;

Check the deadline, conditions, requirements and limitations of the offer;
-
Provide requested materials, access, or information when necessary;
-
Use the platform respectfully;
-
to track the progress of the order;
-
File a dispute within the applicable timeframe, when there is a reason;
-
Do not request services that are illegal, abusive, or inconsistent with these Terms.
Pulsomax is not responsible for failures resulting from incorrect, incomplete, or missing information provided by the customer.
10. Advertisements, descriptions and offers
Advertisements should provide clear information about the service offered.
The service description should include, whenever applicable:

What is not included;

delivery time;
-
Requirements for starting;
-
Delivery format;
-
number of revisions or adjustments included;
-
technical limitations;
-
support conditions;
-
warranty period;
-
external factors that may affect the outcome.
Pulsomax may review, edit, pause, reject, or remove ads that are incomplete, confusing, misleading, irregular, or inconsistent with the platform's purpose.
11. Orders and contracting
By placing an order, the customer agrees to the terms and conditions stated in the advertisement at the time of purchase.
After payment confirmation, the order can be made available to the seller or the Pulsomax team responsible for processing.
When the service is offered by an independent seller, the seller must perform the service according to the advertised conditions and within the stated timeframe.
When the service is offered directly by Pulsomax, the execution will be carried out by Pulsomax itself or by professionals, partners, collaborators or service providers designated for this purpose.
When the service depends on additional information from the client, the deadline may be counted from the correct submission of this information, provided that this is clearly stated in the advertisement, on the service page, in the commercial proposal, or in the communication recorded within the platform.
Pulsomax may cancel orders in cases of payment failure, suspected fraud, rule violations, service unavailability, requests from the parties, or administrative decisions by the platform.
12. Payments
Payments made on Pulsomax must be processed through the methods provided on the platform itself.
The customer should not make payments outside of the Pulsomax environment once the contract has been initiated through the platform.
Pulsomax may use payment intermediaries, gateways, financial institutions, or other providers to process charges, transfers, refunds, and validations.
The final price may include the service fee, taxes, commissions, charges, operating costs, or other amounts disclosed at the time of purchase.
13. Payments to vendors
Payments received from customers for services offered by independent vendors may be temporarily held pending confirmation of delivery, expiration of the security period, anti-fraud analysis, completion of the dispute period, or fulfillment of criteria defined by Pulsomax.
Pulsomax may deduct commissions, operational fees, processing costs, refunds, chargebacks, reversals, internal fines, financial adjustments, or amounts resulting from disputes.
The payment schedule, release timeframe, minimum withdrawal amount, and other financial conditions may be defined and updated by Pulsomax.
When the service is offered directly by Pulsomax, there will be no subcontracting to an independent vendor, unless there is a specific contract with a provider, partner, or collaborator involved in the execution of the service.
14. Warranty and dispute period
Pulsomax may offer the customer a minimum period of up to 30 days to dispute a purchase, depending on the nature of the service contracted, starting from the order confirmation, completion, or delivery of the service.
During this period, the customer may file a dispute if they believe that:

The service was not delivered.

The service was delivered incompletely.

The delivery does not match the description in the advertisement;
-
There was a significant delay;
-
There was a serious flaw in the execution;
-
The seller did not provide adequate support.
-
There was a violation of the platform's rules.
Opening a dispute does not automatically cancel the purchase.
Pulsomax may analyze the information presented by the client, the seller, or the responsible team, request proof, mediate the solution, and make administrative decisions within the platform.
The seller must respond to the complaint within the requested timeframe. Failure to respond may result in a decision in favor of the customer.
For services offered directly by Pulsomax, the platform itself will analyze the customer's request and may offer correction, new delivery, credit, partial refund, full refund, or another solution appropriate to the case.
15. Right of withdrawal
Where applicable, the customer may exercise the right of withdrawal provided for in Brazilian law for contracts entered into outside of a commercial establishment, including online purchases.
The legal period for withdrawal is 7 days, counted from the signing of the contract, contracting of the service or receipt of the product, as provided for in applicable legislation.
In digital, personalized, on-demand services, whether initiated immediately after contracting or already fully executed, the analysis may consider the nature of the service, the degree of execution, proof of delivery, the good faith of the parties, and the specific rules of the offer.
Pulsomax will evaluate each case according to applicable legislation, the information in the request, and the nature of the contracted service.
16. Cancellations, refunds and chargebacks
Orders may be cancelled or refunded when applicable:

failure to deliver the service;

Delivery does not match the description;
-
serious flaw in execution;
-
Significant failure to meet the deadline;
-
Lack of response from the seller;
-
violation of these Terms;
-
suspected fraud;
-
Pulsomax's administrative decision;
-
Exercise of a consumer's legal right, when applicable.
Pulsomax may apply a full refund, partial refund, platform credit, correction request, new delivery, or another solution deemed appropriate.
In cases of chargebacks, reversals, or disputes with the payment processor, Pulsomax may block funds, suspend payments, request documents, and take security measures.
17. Communication between customer and seller
Communication regarding the order should preferably occur through Pulsomax's official channels.
It is forbidden:

Request payment outside of the platform;
-
Direct customers to complete orders through external channels;
-
Sending unauthorized bank details, Pix keys, external checkout links, or payment methods;
-
Treating other users with insults, threats, or harassment;
-
Pressuring customers to close disputes or change reviews;
-
Using customer data for purposes unrelated to the order.
Pulsomax may monitor communications made within the platform for security, support, fraud prevention, dispute resolution, and enforcement of these Terms.
18. Reviews and reputation
Pulsomax may allow customers to rate sellers, services, and shopping experiences.
Reviews should be truthful, respectful, and based on real experiences.
It is prohibited to manipulate reviews, create simulated purchases, offer advantages in exchange for positive reviews, publish false reviews, or unduly harm the reputation of third parties.
A seller's reputation can influence ad visibility, sales limits, approval of new services, balance release, and continued presence on the platform.
19. Intellectual property
All rights relating to the Pulsomax brand, visual identity, layout, institutional texts, systems, functionalities, database, technology, code, design, platform structure and other proprietary elements belong to Pulsomax or its licensors.
The user may not copy, reproduce, modify, distribute, sell, exploit, clone, or misuse any element of the platform without authorization.
The seller declares that they possess the necessary rights, licenses, or authorizations for all materials, files, codes, images, videos, texts, themes, plugins, templates, trademarks, projects, or solutions that they sell through Pulsomax.
If Pulsomax receives a complaint or identifies suspected intellectual property infringement, it may remove advertisements, block funds, request documents, cancel orders, suspend accounts, or take appropriate legal action.
20. User-generated content
The user is responsible for all content that they register, submit, publish, or share on Pulsomax.
By uploading content to the platform, the user declares that they have authorization for its use and grants Pulsomax a limited, non-exclusive, and royalty-free license to store, display, reproduce, and use this content exclusively for the functioning, dissemination, organization, and operation of the platform.
Pulsomax may remove content that violates these Terms, third-party rights, applicable law, or the platform's internal standards.
21. Privacy and data protection
Pulsomax will process personal data in accordance with its Privacy Policy and applicable legislation, including the General Data Protection Law.
The data may be used for registration, identification, order processing, payments, security, fraud prevention, support, communication, legal compliance, platform improvement, and other purposes outlined in the Privacy Policy.
The user must use third-party data in a lawful, secure manner and limited to the necessary purpose.
The seller must use data, files, access, images, documents, information, and materials sent by the client exclusively for the execution of the contracted service.
It is prohibited to sell, share, reuse, disclose, or improperly store customer data without authorization or without a proper legal basis.
22. Account Security
The user is responsible for keeping their login, password, and other access credentials confidential.
Pulsomax is not responsible for damages resulting from misuse of the account caused by user negligence, password sharing, access by third parties, or lack of basic security measures.
The user must immediately notify Pulsomax if they identify unauthorized access, suspect fraud, or misuse of their account.
23. Platform limitations
Pulsomax strives to keep the platform available, secure, and functional, but does not guarantee uninterrupted operation, free from errors, technical failures, temporary unavailability, attacks, maintenance, bugs, or events beyond its control.
Pulsomax may modify, suspend, limit, or discontinue platform functionalities, pages, categories, tools, or services at any time for technical, commercial, operational, legal, or security reasons.
24. Pulsomax's Responsibility
Pulsomax will only be liable within the limits of its role as an intermediary platform, marketplace, and agency providing its own services, and in accordance with applicable law.
When the service is provided directly by Pulsomax, Pulsomax itself will be responsible for its execution, according to the terms of the offer, proposal, service page, or order.
When the service is provided by an independent seller, the direct responsibility for the execution, delivery, quality, support, and fulfillment of the offer rests with the respective seller.
Pulsomax is not responsible for:

technical quality of services performed by independent vendors;

promises made by sellers outside the platform;
-
False information provided by users;
-
materials sent by customers or vendors;
-
Misuse of data by third parties;
-
Results depend on external platforms, algorithms, third-party approval, or factors outside of Pulsomax's control;
-
losses resulting from a violation of these Terms by customers or sellers;
-
Failures caused by external providers, payment methods, hosting, internet, or third parties.
Nothing in these Terms excludes the consumer's legal rights where applicable.
25. Penalties
Failure to comply with these Terms may result, at Pulsomax's discretion, in:

warning;

Limited functionality;
-
content removal;
-
Pause or remove ads;
-
order cancellations;
-
refund to the customer;
-
Temporary balance freeze;
-
Account suspension;
-
Permanent closure of the account;
-
Retaining funds to cover losses, chargebacks, or disputes;
-
Notification to the competent authorities, when necessary.
The application of penalties may take into account the severity, recurrence, risk, damage caused, and the user's history.
26. Account suspension and termination
Pulsomax may suspend or terminate accounts that violate these Terms, pose a risk to the platform, cause harm to third parties, are involved in fraud, or fail to comply with internal rules.
The user may also request to close their account, provided there are no pending orders, outstanding payments, open disputes, or obligations to fulfill.
Even after the account is closed, certain information may be retained for the time necessary to comply with legal, regulatory, tax, security, fraud prevention, and rights protection obligations.
27. Taxes and legal obligations
Customers and vendors are responsible for fulfilling their own fiscal, tax, commercial, professional, and legal obligations.
The seller is responsible for issuing tax documents, collecting taxes, and maintaining authorizations, licenses, or registrations necessary for providing the services, when applicable.
Pulsomax may provide information, reports, or documents related to transactions, according to its criteria and legal obligations.
For services offered directly by Pulsomax, fiscal and commercial responsibility will be observed in accordance with the nature of the service provided and applicable legislation.
28. Third-party links and platforms
Pulsomax may contain links, integrations, tools, or references to third-party websites, services, platforms, payment methods, or systems.
Pulsomax does not control and is not responsible for the policies, practices, content, operation, availability, or security of third parties.
The use of external services will be subject to the terms and policies of those third parties.
29. Results of digital services
Services related to digital marketing, social media, SEO, content, traffic, design, development, online presence, page optimization, WordPress, WooCommerce, or external platforms may depend on technical, commercial, operational, and external factors.
These factors may include user behavior, algorithms, competition, quality of materials provided, external platform settings, third-party policies, indexing time, content approval, system stability, and other variables beyond the direct control of Pulsomax or independent vendors.
Therefore, unless expressly and objectively stated in the offer, Pulsomax and the sellers do not guarantee absolute, permanent, or specific results that depend on external factors.
The information presented in advertisements, service pages, or proposals should be interpreted according to the terms, limits, and characteristics of each service contracted.
30. Changes to the terms
Pulsomax may update these Terms and Conditions at any time to reflect legal, technical, commercial, operational, or safety changes.
Changes may be communicated through the platform, email, user panel, or by posting on the official page.
Continued use of the platform after the update will be considered acceptance of the new Terms.
31. General provisions
If any clause of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable.
Pulsomax's eventual tolerance of any rule violation will not be considered a waiver of rights.
These Terms should be interpreted in conjunction with the Privacy Policy, Seller Policy, Refund Policy, Warranty Policy, and other official documents of the platform.
32. Jurisdiction and applicable law
These Terms shall be governed by the laws of the Federative Republic of Brazil.
Any disputes will preferably be resolved through Pulsomax's customer service channels.
If an amicable solution is not possible, the competent court will be determined according to applicable legislation, especially when a consumer relationship is involved.
33. Contact
In case of doubts, requests, complaints or communications related to these Terms, the user may contact Pulsomax through the official channels available on the platform.
34. Final acceptance
By accessing, registering, buying, selling, advertising, or using Pulsomax, the user declares that they have read, understood, and fully accepted these Terms and Conditions of Use.
The user also declares to be aware that Pulsomax may act both as a service marketplace, connecting clients to independent sellers, and as an agency providing its own services related to content, social media, SEO, digital marketing, WordPress, WooCommerce, design, development, digital optimizations, and other solutions compatible with its commercial proposal.
